      <title>Baxter Expands Recall of Infusion Pump Class 1 Recall</title>
      <description>&lt;p&gt;&lt;a href="http://www.fda.gov/oc/po/firmrecalls/baxter08_07.html"&gt;Baxter International Inc.&lt;/a&gt; has expanded their recall on its Colleague and Flo-Gard infusion pumps to include 986 more devices.  The previous recall , which was announced on July 25, included 534 pumps that were recalled due to &lt;a href="http://honolulu.injuryboard.com/class-1-recall-of-baxter-colleague-and-flogard-volumetric-infusion-pumps.php"&gt;falsified service records&lt;/a&gt;.  &lt;/p&gt;&lt;p&gt;The company discovered that some of the devices sent to the Baxter service center may have been sent back to consumers without being serviced.  Baxter found falsified repair, test, and inspection data sheets, which included electrical safety data.  The employees responsible for the falsified data were fired.       <title>Wiretap Lawsuit Against Bush</title>
      <description>&lt;p&gt;The federal government in an effort to maintain national security is urging an appeals court to drop a lawsuit filed over President Bush's eavesdropping program. The Justice Department argued that the alleged secret relationship between AT&amp;T and the government should remain a state secret.       <title>Lawyers for Katrina Victims Withdraw Settlement Motion</title>
      <description>&lt;p&gt;The lawyers representing approximately 36,000 Hurricane Katrina victims withdrew from a proposed settlement with State Farm Mutual Automobile Insurance.  The judge was reluctant to approve the settlement and the lawyers plan to file a new settlement proposal.       <title>State Officials Order Allstate to Reduce Homeowners' Rates</title>
      <description>&lt;p&gt;The Allstate Insurance Company must reduce Texas homeowners insurance rates by 5% as ordered by the Texas Department of Insurance.&lt;/p&gt;&lt;p&gt;Allstate must also refund overcharges made since December 2004 which amounts to an estimated $56 million dollars.       <title>Party hosts escape liability for drunk-driving injuries</title>
      <description>&lt;p&gt;A man who was uninsured when he drove while drunk caused the accident that resulted in the plaintiff's injuries. &lt;br /&gt;Further, he had no personal assets which could be used to satisfy the judgment against him. Instead, the plaintiff had to resort to suing the hosts of the party where he had consumed alcohol prior to getting into his car. &lt;/p&gt;&lt;p&gt;The hosts had homeowner insurance which could cover their liability in the accident. However, the Supreme Court of Canada (SCC) unanimously held that social hosts had no duty of care to public users of highways. Simply providing a place where alcohol could be consumed was insufficient in creating a risk that would give rise to a duty to take positive action to stop an intoxicated guest from driving home. In this, the SCC drew a distinction between social hosts and commercial hosts, who are in a better position to observe and control the consumption of alcohol and more responsible for the creation of any risks caused by such consumption.       <description>&lt;p&gt;The Senate Judiciary Committee has set a hearing on Tuesday afternoon for legislation by Sen. Mark Norris, R-Memphis, and Sen. Doug Jackson, D-Dickson, that limits medical professional liability or requires pre-certification of medical malpractice cases.
